Multi-employer Worksite Safety Issues 2

Case Description/Summary:  

An independent contractor working at a construction project was injured when a scaffold plank became dislodged from the tubular scaffold he was working from causing him to fall approximately six (6) feet (+) to the ground below. Just prior to the subject accident event, another company working on the project was allegedly digging a trench below the subject scaffold system.  Case discovery documents indicated that the second company altered the scaffold plank of the subject scaffold system on which plaintiff was walking at the time of this accident event.

Expert Analysis/Summary:

A construction safety analysis included a review of all relevant depositions and other discovery documents, reports, training records, photographs, etc. In addition, a review of relevant research materials, codes, and standards related to acceptable workplace safety practices and standards was performed. It was determined that employees of the second company created a hazardous condition when they altered the scaffolding plank to dig a trench below the scaffolding system.

 

Results:   Verdict for plaintiff.
