A warehouse worker and overhead crane operator working in a warehouse was injured when he was struck by a roll of steel that he was attempting to move with an pendant-controlled crane. The employee had completed numerous crane operating courses and was experienced performing the same job on numerous occasions prior to the accident with the subject pendant-controlled crane.
SPA, inc. reviewed the discovery documents and relevant research materials, codes, and standards related to materials handling and human factors engineering analysis. SPA, inc. also included a review of all relevant depositions and other discovery documents, reports, operator’s manual, training programs documentation, photographs, etc.
It was determined through the review of the discovery documents that the employer met all the requirements placed on an employer as outlined in West Virginia’s deliberate intention code.
Results: Case resolved in a favorable manner.
